Innocent Until Proven Muslim




The five Salah (prayers) are Fard (obligatory) on the Muslims, likewise the Sawm (fast) in Ramadan is obligatory on the Muslims. To do Da'wah (enjoining the good and forbidding the evil in society) is obligatory on the Muslims. The freeing of Muslims in captivity (Aseer) is also obligatory on the Muslims exactly like praying Salah, keeping the Sawm and doing Da'wah. Muslims that are being held as prisoners all over the world need to be released by the Ummah of Islam. There is no dispute or legal difference of opinion on this issue at all between the Salaf (Sahabah, Tabi'een, Tabi Tabi'een) and the Ulamaa' of Ahlus Sunnah wal Jama'ah. Imam Abu Hanifah (rh) has been quoted as saying, "To release Muslims from captivity whether in the East or the West (of the world) is obligatory." [Imam Sarkhasi, Al-Mabsoot and Tafsir Imam Badawi] Imam Maliki (rh) said, "Any Muslim residing amongst non-Muslims enjoys the same rights as a Muslim residing amongst Muslims, and if they are in captivity it is the duty of the Islamic State (Khilafah) to release him and if there is only one of us left (i.e. no Islamic State) it is obligatory for him (that person) to release him (the prisoner)." [Imam Sheikh Khaleel Al-Maliki in his Mukhtasar] Abdul Rahman ibn Amrah was sent to ransom the Muslim prisoners being held in Constantinople. He asked the rightly guided Caliph Umar ibn Abdul Aziz (rh), "Oh Commander of the Believers! What do you advise I do if they refuse to ransom one man (non-Muslim) for one man (Muslim) -- what should I do?" Umar (rh) said, "Offer them another non-Muslim." Until he asked, "What if they demand four non-Muslims for the release of one Muslim?" Umar (rh) said, "Give them whatever they want for the release of the Muslims. For by Allah, By Allah! A single Muslim is more beloved to me than all the pagans which I hold captive. You are not just ransoming a Muslim. You have won even more: you are purchasing Islam." It has also been reported that Umar ibn Abdul Aziz (rh) said, "It is obligatory upon any Muslim with capability to release Muslim captives." [Ibn Qudamah in his Mughni] One of the great Mufassirs (exegetes of the Quran), Imam Qurtubi (rh), said, "How dare us that we are in Fitnah (e.g. fighting amongst ourselves), when the non-Muslims take Muslims as prisoners!" [Tafsir Qurtubi] From Andalusia (Spain, northern France, Portugal) Ibn Hazm (rh) said, "It is the consensus (Ijma) of the Companions, that if the only way to release Muslims from captivity is to gather all the money from the Ummah, it becomes Wajib (compulsory) to do this." [Muhallah Bab-ul-Aseer] Sheikh-ul-Islam Ibn Taymiyyah (rh) said, "To release the Muslim prisoners is one of the greatest obligations, and to spend money in this way is the best form of Ibadaat (worship - to come close to Allah (swt)." [Majmoo Al-Fatawa, Kitab-ul-Aseer, Volume 28, Page 635] Muslims in the UK have to follow the Islamic Minhaaj (Method) to release our brothers and sisters from captivity and that is to raise public opinion and awareness by attending demonstrations, writing leaflets, involving yourself in campaigns to help the captives. We can also collect funds for bail to guarantee and secure their freedom. We need to understand we are not purchasing a product, rather we are buying Islam. Oh Muslims, the Haq (rights) of our Ummah are being violated daily all over the world and we should fulfil all of our duties (be they Izhaar-ul-Deen, implementing the Shari'ah, Da'wah, Jihad etc.) to Allah (swt) by completing them to the best of our abilities. One of these noble duties is to regularly make Dua (supplication), imploring Allah (swt) for the safe and immediate return of the prisoners. Jabir ibn Abdullah reported that our beloved Prophet Muhammad (saw) said, "No man helps a Muslim at a time when his honour is being belittled or his rights violated except that Allah will help him at a place in which he loves to have His help."
